A dubious decision

Every now and again a court renders a decision that would appear, for all intents and purposes, that the members of that court have lost whatever touch with the reality to which they might have, at one time, laid claim.And then there's the Manitoba Court of Appeal and their incredible - no, unbelieveable - decision, as reported in the Winnipeg Free Press (Hells Angel allowed to chat with biker buddies, says high court), in the case of Hells Angel Shane Kirton who had pled guilty to an unprovoked, vicious assault on an unsuspecting bar patron. And not, I might add, his first go 'round with the law. But, back to the decision at hand. The Court of Appeal overturned the decision of Queen's Bench Justice Holly Beard to impose conditions on Kirton that he refrain from contact with his brother Hells Angels for the duration of his probation. Apparently, according to the Appeal Court, that condition infringes on his right to freedom of association guaranteed in the Charter of Rights and Freedoms and that the lower court should not have taken judicial notice that the Hells Angels are a criminal organization. Chief Justice Richard Scott said, "It is hard to escape the conclusion that the sentencing judge was led astray by her preoccupation with the accused’s involvement with the Hells Angels.” Oh? Climate of Doubt

In the wake of the costliest gabfest in the history of man that has just concluded in Copenhagen and  that achieved absolutely nothing but a $100 Billion shakedown of America and its allies, I found myself in plane from Toronto to Vancouver. Flying over the frozen prairie of the North American west,  I was staring down at a frigidity only known to those hearty enough to choose to reside there. I was also privileged enough to have borne witness to history last Sunday at the Edmonton Airport as I travelled to catch a flight and the temperature was a bone-rattling minus 46 with a wind chill that took it to minus 58. I thought I was developing Taurette’s Syndrome. When I went out I had an inadvertent reaction: F***, F***, F***! Now admittedly, I am not a scientist. I’m an old time cop, investigator and professional cynic.  In that role I know that there are always three sides to any story and people will always “guild the lily”  to achieve maximum personal benefit, whatever the circumstances in which they find themselves.  And, I have to also state that I neither stake a claim to being a Global Warming believer nor a ‘denier,’ to use a phrase coined by the  wild-eyed, foamy mouthed, true believers. A crass act

One wonders if a more disingenuous press conference has been held in recent memory than the one held by lawyer Don Morrison and his “victim” clients, Vancouver firefighter Curtis Mason and his smarmy son, Grant.Yup, butter wouldn’t melt in that kid’s mouth now would it?The Masons were in front of the cameras claiming they were just minding their own business when members of the Vancouver Police Department jumped them. The video clip posted to YouTube by a Seattle resident clearly shows a different picture. In the video, we see three police officers engaged in what is called ground fighting with two men. And the fight is truly on. One of the individuals was fighting back against two VPD members and the other was one on one. The one on one battle is clearly going badly for the officer as they roll over a couple of times and the bad guy seems to be gaining the upper hand when Sgt. Keiron McConnell shows up and smacks the bad guy twice with his baton and helps the struggling officer gain control and hand cuff the offender.Also in the picture are a few firemen just standing around looking on. They had been on the scene because the Masons were in a traffic collision with a building. Were they intoxicated? Late on Saint Paddy’s Day? Disingenuous or Dumb?

Vancouver Mayor Sam Sullivan is either one of the most disingenuous local politicians in a long time or one of the dumbest.When, in the last civic election campaign it became known that Sullivan had given an addict money to purchase drugs and had driven him around in his van ostensibly because Sullivan wanted to learn more about addiction or some such nonsense, I thought he must be an idiot.But, he managed to run a successful campaign and in the year and a half or so since he has been mayor of Canada’s third largest city, he hasn’t done anything really outrageous or spectacular for that matter.But, his statements in the media yesterday after the media reported that the Drake Hotel, purchased by the city for three times its assessed value, was owned by a numbered company which had Hells Angel East End chapter president John Peter Bryce as the sole company officer, was a surprise to him is outrageous.Notwithstanding any other of the numerous public source reports, last year the Vancouver Sun ran a series about the biker gang called Hells Angels Inc. in which they detailed in depth the various business holdings of the Hells Angels and central to that were the real estate holdings of Bryce and other gang members.Does Sullivan not read front page stories in major media about what is happening in the city he presides over? Business as usual for the Godfather of the House

What really amazes me is that even in disgrace, former Liberal cabinet minister, Quebec party bagman and quite possibly the most corrupt politician this country has ever seen, Alfonso Gagliano, was able to extract a $500,000 loan from an obscure arm of the federal government called Farm Credit Canada to buy a vineyard, apparently.Gagliano was the central figure in the Adscam debacle which ultimately undid two Liberal Prime Ministers, though both deny that essential and plainly obviously fact. He was also named by FBI snitch and career mobster Frank Lino, as a "made" guy and member of the Bonnano crime family.  Is it true? I don't know. But I do know that he had much to cozy a relationship with Augustino Cuntrera when he was the accountant for some companies of the family dubbed the "Rothchilds of the Mafia."  He was also a founding member, along with Cuntrera, and on the executive of a "club" called the Siculiana / Cattolica Eraclea Society in the 90's.  I also know that Lino had no reason to lie at that point.Gagliano came out denying it all in the media claiming Italian discrimination.  Really, it's all a plot against the Italians.  He threatened a lawsuit, but none was forthcoming.  One suspects that was because he could never allow himself to be cross-examined on the question.  Unlike our Human Rights kangaroo courts - oops sorry - tribunals, in civil court the truth is an absolute defence.Well, the "Godfather" of Parliament no longer has his...

The job of Chief Constable of a modern police service is a difficult one. The occupier of the office has to be one part politician, one part police officer and one part masochist. In Calgary, it would seem, that Chief Constable Jack Beaton has managed to get and keep the top job without any of the required skills.Having met Beaton, I am pretty sure he is not an idiot. So, why does he keep doing and saying such idiotic things?Without delving too deeply into it, let’s take a peek at the past few days.The Calgary Police Association this past week released the results of a poll of its members which said, in a nutshell, that the rank and file had no confidence in the leadership of the Calgary Police Service and that the vast majority wanted a new chief to be recruited from outside the service.Pretty stunning stuff really. Beaton has been, frankly, an embarrassment to the taxpayers of Calgary with some of the idiotic things he has said publicly. Where to start? Hmm…well there was the lunacy he spouted about not thinking that police officers in China wouldn’t be able to speak English He apparently found out this little gem of the incredibly obvious when he was in China on an indefensible junket. . . sorry, recruiting drive.. Liberal sleaze laid bare

Pure unadulterated sleaze.If there was ever any doubt that the Liberal Party of Canada was corrupt to the core, yesterday's release of the testimony of Jean Brault, Paul Coffin and the Sultan of Sleeze, Chuck Guite, ought to have removed the blinders from even the most naive of the editorial board of the Toronto Star, the unofficial organ of the federal Liberals. Depictions of gifts, benefits and Formula One tickets are bad enough, but the direction made by Guite to make a $50,000 donation to Quebec Liberal leader Jean Charest's campaign and recover the money by padding govenment contracts shows the core corruption that ought to even make Paul Martin blush with embarrassment. But it won't. Martin and his cronies are already planning how to spin the next election which is supposed to be called after Justice Gomery releases his report which is sure to be damning. Wait for it, Conservative Leader Stephen Harper will continue to be painted as "scary" and Martin will cluck his tongue about how "unacceptable" the advertising scandal is and how he took action when he finally found out about it. And the editorial board of the Toronto Star will fall in lock-step with Martin and his corrupt government. Again.The picture illustrated by Adscam is depressingly familiar. Hang ‘em high

The biggest story of the day is, without a doubt, the execution of the Beast of Baghdad, Saddam Hussein. Try as I might, I can’t seem to get terribly worked up about it.In the hours after photos and video of the hanging were rocketing around the internet, Sweden, Switzerland and the Vatican all issued statements decrying the execution of a man that was directly and indirectly responsible for millions of deaths. I don’t get it.Ever since they dragged his lice-bitten ass from a rat hole it was clear his days were numbered. The only mystery was why it wasn’t done in the forecourt of one of his former palaces and broadcast on big screens around the country.Saddam was little more than a bully. Only he took the bullying to violent extremes. Think of Joe Stalin without the finesse.All the lefties, hand-wringers and anti-American types lined up and in unison began decrying the barbarism of the execution. It’s amazing they don’t get nosebleeds, so high up on the higher moral ground they claim to be perched.The best one though had to be the American lawyers who had petitioned a US Judge to halt the execution because - wait for it - Saddam still faced a civil suit in America. Perish the thought the Iraqis might hang one of history’s most prolific mass murderers before he could play in the great American pastime.The media hand-wringers were prominent and fast out of the gate. More needless death

Another man is dead because of a couple of habitual car thieves. When do you suppose, will the politicians in power in Ottawa finally understand that something needs to be done?How many innocent people need to die before the lib-left finally figure out that habitual criminals need to be jailed not coddled.If the tragedy at Mayerthorp wasn't the impetus for change, what pray tell me, will be? But the outrage after that seems to have died down and like the story out of Richmond, BC today shows, more people are dying at the hands of people the justice system could have, and should have, dealt with.Leo Knight
